Create a midyear CIP titled Fayette Park. 2. Appropriate $200,000 from the Park In-Lieu Fund using fees received from the 2650 and 2656 El Camino Real West housing project to the new Fayette Park project. (Five votes required) BACKGROUND On June 26, 2012, the City Council approved a Planned Community Permit for the 2650 and 2656 El Camino Real West housing project. The developer, Urban Housing Group (UHG), requested that a public park be constructed on the adjacent Hetch Hetchy right- of-way concurrently with their development and that the City Council direct a portion of the Park In-Lieu fee to fund design and construction of the park. The conditions of approval required UHG pay a portion ($200,000) of their Park In-Lieu fee early so conceptual design of the park could begin. The City will manage the design process in a manner similar to other City parks and construct the park as a capital improvement project. ANALYSIS UHG has made the initial $200,000 payment, and the recommended actions would begin the design process by creating and funding a capital improvement project. The conceptual design process will be similar to other public parks, including meetings with the surrounding neighborhood, preparation of alternative layouts for the park, review of the conceptual design by the Parks and Recreation Commission, and review and approval of the conceptual design by the City Council. Staff will return with a recommendation to appropriate additional funding to the project to complete design and construction of the park after the balance of the Park In-Lieu fee is paid. Fayette Park—Create Midyear CIP/Appropriate Funds September 11,2012 Page 2 of 3 The Guzzardo Partnership, Inc., Landscape Architects (GP), is the developer's landscape architect for the development and staff recommends that GP also be employed as the landscape architect for the park rather than issuing a Request for Proposals from multiple designers. City policy permits a sole-source contract for professional services if it is justified and is in the City's best interest. Because GP is already on the developer's design team, is familiar with the project, and will be designing the landscaping improvements throughout the housing project, staff feels that employing GP for the conceptual design is justified, cost-effective and in the City's best interest. Staff interviewed representatives from GP and evaluated the firm's qualifications and experience and determined they are qualified to perform the work. GP has designed a number of similar public parks, including Mountain View's Sierra Vista Park. Project Cost The estimated cost of conceptual design is as follows: Conceptual Design Services $ 50,000 Environmental Investigation 10,000 SFPUC Permitting 5,000 Project Management 35,000 Public Outreach/Advertising/Misc 10,000 Subtotal $110,000 City Administration (6.5%) 7,000 TOTAL $117,000 Project Schedule Conceptual design is scheduled to be complete in early summer 2013, and construction of the park is scheduled to be complete in mid-2014 to coincide with completion of the housing development. FISCAL IMPACT The estimated Park In-Lieu fee for UHG development at 2650 and 2656 El Camino Real West is $3.8 million. UHG paid $200,000 of the Park In-Lieu fee early so conceptual design of the park can begin. Conceptual design is estimated to cost $117,000. UHG Fayette Park—Create Midyear CIP/Appropriate Funds September 11,2012 Page 3 of 3 will pay the balance of their Park In-Lieu fee prior to issuance of the building permits. The total cost of design and construction of the park is estimated to be$1.4 million. The portion of UHG's Park In-Lieu fee not allocated to the park (approximately $2.4 million) will be deposited in the Park Land Fund. The estimated annual park maintenance cost is $11,000. ALTERNATIVES The recommended actions are consistent with the park development process defined in the project conditions approved by Council on June 26, 2012. If Council approves a different park development process or reconsiders building the park in conjunction with the housing development, staff will schedule an Administrative Zoning hearing to amend the development accordingly.
