HomeMy WebLinkAboutOrdinance - Amend Ch. 38 to Allow Roller Skating at Shoreline ORDINANCE NO. 7.92 AN ORDINANCE AMENDING CHAPTER 38 OF THE MOUNTAIN VIEW CITY CODE TO ALLOW ROLLER SKATING AT SHORELINE WHEREAS, Section 38.20(g) of the Mountain View City Code prohibits roller skating at Shoreline based on a concern of conflicts between multiple-trail uses at the park such as joggers and cyclists; and WHEREAS, for a period of one year the City has allowed roller skating at Shoreline on a trial basis and has determined that conflicts in use can be successfully managed to accommodate the increasing interest in roller skating; NOW, THEREFORE, the City Council of the City of Mountain View does ordain as follows: Section 1. Chapter 38, Article I, Section 38.20(g) is hereby amended to read as follows: "SEC. 38.20. Special provisions for Shoreline Park. ['" '" "'] g. Bicycle riders, hikers, and joggers shall be limited in the use of all premises to the prepared trails and boardwalks designated for such purposes. Skateboards shall be prohibited in Shoreline Park." _. Section 2. The provisions of this ordinance shall be effective thirty (30) days from and after the date of its adoption. Section 3. If any section, subsection, sentence, clause or phrase of this ordi- nance is for any reason held to be unconstitutional, such decision shall not affect the validity of the other remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses or phrases be declared unconstitutionaL Section 4. Pursuant to Section 522 of the Mountain View City Charter, it is ordered that copies of the foregoing proposed ordinance be posted at least two (2) days prior to its adoption in three (3) prominent places in the City and that a single publication be made to the official newspaper of the City of a notice setting -1- forth the title of the ordinance, the date of its introduction, and a list of the places where copies of the proposed ordinance are posted. The foregoing ordinance was regularly introduced at the Regular Meeting of the City Council of the City of Mountain View, duly held on the 17th day of March, 1992, and thereafter adopted at the Adjourned Regular Meeting of said Council, duly held on the 31st day of March, 1992, by the following roll call vote: AYES: Councilmembers Bonnell, Cochran, Figueroa, Frosolone, Schatz, Shaskey, and Mayor Takahara NOES: None ABSENT: None NOT VOTING: None ATTEST: APPROVED: ~ ANGELITA M.
